Citizenship, Nationality and Refugees
A child born in the UK before 1 January 1983 is automatically a British citizen irrespective of the nationality of his or her parents. Children born in the UK after that date are entitled to British Citizenship only if one parent is a British Citizen or is settled in the UK at the time of their birth. In July 2006 the law was amended to allow unmarried to transmit their nationality to their children in the same way as married fathers.
A child who is not a British Citizen but is adopted by British Citizens becomes entitled to citizenship from the time of the adoption order.
The OCC has raised concerns that children who are British citizens are effectively being expelled from the UK in circumstances in which the parent with care is a third country national without leave to remain.
