Prevention of processing for direct marketing
Section 11 sets out your right to prevent any information about you being processed for the purposes of direct marketing. This covers personal mail, fax, telephone calls and emails. It may also prevent an advertising or marketing company from carry out screening or data-mining activities even where that process does not result in you being directly targeted.
Additional provisions apply to marketing by telephone, email or SMS. In order to use automated dialling machines or fax marketing, the data controller must have obtained your prior consent.
Similarly, any electronic marketing such as e-mail or SMS requires the consent of an individual subscriber except where the marketer is marketing similar goods and services to existing customers who have been made aware of the opportunity to opt out of the use.
You can require a data controller to stop processing your personal data for the purpose of direct marketing. When a data controller receives such a notice, he must comply as soon as he can. You may apply to Court for an order if the data controller fails to comply with the notice.
You may also seek damages under section 13 if the data controller fails to respond to a proper objection and causes you to suffer damage.
