If you do not agree with a decision made by the Department of Works and Pensions in respect of a benefit you have claimed or are receiving, then as a first step you can ask them to explain the decision. If you are not satisfied with the explanation, you can ask Department of Work and Pensions to review its decision internally.

It may be possible to appeal the decision to the Appeals Service who will decide your appeal at a tribunal hearing. The tribunal is made up of people who are not from the Department of Work and Pensions or Jobcentre Plus. The tribunal will only look at the evidence, the law and the circumstances at the time the relevant decision was made.

You can challenge a tribunal decision if you think the tribunal has made an error when applying the law. You can do this by applying to the Social Security and Child Support Commissioners. If you want to appeal to the Commissioners, you must first apply to the Appeals Service for permission. Your application will be considered at the Appeals Service by a District Chairman. The District Chairman will return your application to you, with permission granted or refused. You can then decide to send your application to the Office of the Commissioners, with the District Chairman's decision.
