My friend is in a removal centre. Is he entitled to bail?

There is a presumption in English law that anyone detained is entitled to bail. This applies to detention removal centres as well as prisons.

The Immigration Service can only detain someone if they can show detention is necessary. Almost any person detained by the Immigration Service can ask to be released under certain conditions. If your friend has been in the UK for more than 7 days he can apply for bail in the immigration courts.

You should contact Bail for Immigration Detainees (BID) who specialise in this area as they may be able to assist. BID publishes notebooks which provide a full explanation of how to apply for bail and sets out the factors relevant to a bail application.
